Terms of Use

These Terms of Use explain the rules for using Nomadicare and the responsibilities we each have. Please read them carefully, especially the warranty disclaimer and limits on liability.

Our Privacy Policy explains how we handle personal information. It does not replace any separate consent required for marketing, messaging, or sharing your information.

1. Using our services

These Terms of Use apply to the websites and other services that link to them (the “Services”). “Nomadicare,” “we,” “us,” and “our” refer to Nomadicare, LLC, a Texas-based limited liability company. “You” means the person using the Services and, where you act with authority for an organization, that organization.

By using the Services after these terms are made available to you, or expressly accepting them when prompted, you agree to these terms to the extent permitted by law. If you do not agree, do not use the Services. You must be at least 18 and legally able to enter into an agreement to create an account or request services. You may act for someone else only with their permission and appropriate authority.

Additional notices, terms, or signed agreements may apply to particular services. A separate agreement controls over these terms for the subject matter it specifically addresses.

2. Nature of the Services

Nomadicare provides information, resources, and services related to healthcare careers. We are not your employer, a staffing agency, or a party to an agreement you enter into with a third party. The Services do not create an employment, agency, fiduciary, or professional advisory relationship between you and Nomadicare.

We may have commercial relationships with participating providers. Their inclusion does not mean we represent every provider or have evaluated every available alternative. Any required sponsorship or affiliate disclosure will accompany the relevant offering.

3. Third-party services and outcomes

When you submit a recruiter matching request, you authorize Nomadicare to share your name, email address, phone number, matching responses, and relevant professional information you submit for that request with the recruiters we match you with and their staffing agencies. When you apply for a job through our Services, you authorize us to share the information relevant to your application with the recruiter, staffing agency, or employer handling that opportunity. This sharing allows those recipients to consider your request and contact you as described in Section 7.

Recruiters, agencies, employers, and other third parties are independent of Nomadicare and are responsible for their own conduct, representations, and agreements. An introduction or recommendation does not obligate you to engage a provider and does not certify that provider or guarantee future performance.

Except for an express guarantee published by Nomadicare on our website or provided in a separate written agreement, we do not guarantee employment, availability, compensation, savings, tax treatment, or any other outcome. Any express guarantee is limited to its stated terms and does not make us responsible for a third party’s conduct. Nothing here overrides an express obligation we are legally required to honor.

Information supplied by third parties may be incomplete, inaccurate, outdated, or withdrawn. You are responsible for verifying material information, reviewing agreements, and obtaining appropriate advice before making decisions or commitments. Tell us about concerns through our support channels.

4. Information and professional advice

Content, estimates, guidance, and other materials provided through the Services are for general informational purposes. They are not individualized legal, tax, accounting, financial, insurance, medical, or employment advice and do not establish a professional-client relationship.

Information and automated outputs may contain errors or rely on assumptions that do not apply to you. Independently verify any result before relying on it, and consult a qualified professional about your circumstances. You remain responsible for your decisions, submissions, and communications.

5. Accounts and acceptable use

Provide accurate information, keep it current, protect your credentials, and report suspected unauthorized access promptly. You are responsible for activity you authorize and for people you permit to use your account. Do not impersonate another person or submit information you lack permission to use.

You may not use the Services unlawfully; harass, threaten, or defraud others; send unlawful or unsolicited communications; introduce harmful code; bypass access controls; interfere with operation; or access information outside your authorization. You may not scrape, harvest, resell, or redistribute restricted data or proprietary materials without our written permission.

You may not reverse engineer the Services, attempt to obtain nonpublic code or confidential information, or use our proprietary materials to train commercial models, except to the extent applicable law gives you a right we cannot restrict. Business users must maintain appropriate permissions for personal information they submit or use and comply with applicable privacy, employment, and communication laws.

6. Your content and our intellectual property

You retain your rights in content you submit. You grant us a nonexclusive license to store, process, reproduce, format, and transmit it as reasonably needed to provide, secure, and maintain the Services, carry out your instructions, and comply with law, subject to our Privacy Policy. You represent that you have the necessary rights and permissions.

Content you intentionally make public may be accessible to others. We may remove unlawful content or content that violates these terms. Honest reviews, complaints, reports to regulators, and legally protected speech are not prohibited, and posting a review does not transfer its ownership to us.

Our branding, software, designs, original content, and proprietary technology belong to Nomadicare or its licensors. You receive a limited, nonexclusive, revocable right to use the Services for their intended purpose, subject to these terms. No ownership or rights in our confidential information or trade secrets are transferred. We may use voluntarily submitted suggestions without payment, subject to any separate confidentiality agreement and without acquiring ownership of your reviews or personal content.

7. Communications and third-party links

Recruiter matching and job follow-up. By submitting a recruiter matching request or job application after these terms are made available to you, you authorize Nomadicare and the recruiters, staffing agencies, or employers receiving that request or application to contact you at the phone number and email address you provide, including by phone call, text message (SMS), or email, about your request, application, and relevant job opportunities. This permission is limited to those purposes and recipients; it does not authorize disclosure to unrelated marketers. You confirm that you are the subscriber or authorized user of the phone number you provide and have authority to give this permission. Tell us and any recipient contacting you if that number changes or you withdraw permission.

Marketing and automated communications. Communications remain subject to your preferences and applicable consent requirements. A matching request, job application, acceptance of these terms, or provision of a phone number does not by itself supply any separate consent legally required for calls or texts using an automatic telephone dialing system or an artificial or prerecorded voice, including automated marketing. Where required, that consent must be obtained separately before those communications are sent. Marketing consent is not a condition of purchasing or requesting services.

Messaging choices. For SMS, message frequency varies, carrier message and data rates may apply, and delivery is not guaranteed. To opt out, reply STOP where replies are supported, follow the instructions in the message, or contact the sender directly. For help, contact the sender or use any help instructions in the message. For Nomadicare messages, you may also contact hello@nomadicare.com. We honor other clear revocation requests as required by law. Use the unsubscribe link in promotional emails to opt out. Matched recruiters and agencies are independent senders responsible for their communications, required consents, and opt-out handling. Opting out with Nomadicare does not automatically opt you out with an independent recruiter or agency; contact them directly to stop their communications. Contact us if you need help identifying a recipient.

Third-party websites and services are governed by their own terms and privacy policies. You are responsible for reviewing them and any permissions you grant. We do not control third-party availability, security, conduct, or delivery of communications.

9. Changes, suspension, and availability

We may update, limit, or discontinue features and may suspend or end access for misuse, security concerns, nonpayment under a paid agreement, legal requirements, or material violations of these terms. We may provide notice or an opportunity to address an issue at our discretion, and will provide any notice or process required by applicable law or a separate agreement. Immediate action may be necessary to protect people, data, or our Services. Paid-service obligations remain subject to the relevant agreement and law.

We do not promise uninterrupted availability, permanent storage, a particular response time, or any particular functionality. Keep your own copies of important documents and records. We are not responsible for delays caused by events beyond our reasonable control, including provider outages, carrier failures, natural disasters, and government action, subject to obligations that cannot legally be excluded.

10. Warranty disclaimer

To the fullest extent permitted by law, the Services are provided “as is” and “as available.” Nomadicare and its licensors disclaim implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement, and do not warrant that information is complete, accurate, current, or error-free. No informal statement creates a warranty beyond an express written commitment we have made. This disclaimer does not override an express guarantee published by Nomadicare on our website, a separate signed agreement, or rights and warranties that applicable law does not allow us to exclude.

11. Limits on liability

To the fullest extent permitted by law, Nomadicare and its owners, officers, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, revenue, business opportunities, anticipated savings, or data arising from the Services, even if advised that such damages were possible.

To the fullest extent permitted by law, our aggregate liability for claims arising from or relating to the Services will not exceed the greater of $100 or the amount you paid directly to Nomadicare for the Service giving rise to the claim during the 12 months before the event giving rise to the claim. This limit applies across legal theories, including contract, tort, and negligence, and related claims are counted together. A separate signed agreement may provide a different limit.

These exclusions and limits do not apply to fraud, willful misconduct, gross negligence, or any liability or remedy that applicable law does not permit us to exclude or limit. They apply only to the extent allowed in your jurisdiction.

12. Responsibility for third-party claims

To the extent permitted by law, you agree to indemnify Nomadicare and its officers, employees, and contractors against third-party claims, resulting damages, and reasonable legal costs caused by your unlawful use of the Services, your material violation of these terms, or content you submit that infringes a third party’s rights. This obligation does not apply to the extent a claim results from our own misconduct or breach.

We will give you reasonable notice of a covered claim and a reasonable opportunity to participate in its defense. No settlement may impose an admission, nonmonetary obligation, or unreimbursed payment on us without our consent. This provision does not require you to pay our costs simply because you bring a good-faith complaint or claim against us, exercise a privacy right, or post an honest review.

13. Disputes and rights that remain yours

Please contact hello@nomadicare.com with your concern, the relevant account or transaction, and the resolution you seek. We encourage both sides to try to resolve a dispute informally for 30 days. This is not a requirement to delay a filing, miss a legal deadline, or forgo urgent relief.

These terms are governed by Texas law, without regard to its conflict-of-law rules, except where applicable federal law or mandatory protections under the law where you live require otherwise. To the extent permitted by law, disputes arising from these terms or the Services must be brought in a state or federal court of competent jurisdiction in Texas, and you and Nomadicare consent to personal jurisdiction there. This does not restrict a nonwaivable right to bring a claim in your local courts or an eligible small claims court, report a concern to a regulator, or seek a remedy required by applicable law. A valid separate signed agreement may provide different dispute terms.

14. Updates and other terms

We may revise these terms and will update the date above. We will post revised terms on this page and provide any additional notice or request renewed acceptance as required by applicable law or a separate agreement. Changes apply prospectively and do not retroactively reduce rights for a dispute that has already arisen.

If a provision is unenforceable, the rest remains effective to the extent possible. A failure to enforce a provision is not a waiver. These terms and applicable product-specific agreements form the agreement about the Services they cover. You may not transfer your rights under these terms without our permission. We may transfer ours in a merger, acquisition, reorganization, or sale of the relevant business, subject to applicable law and without reducing nonwaivable rights. Provisions intended to survive termination, including intellectual property, payment obligations, liability limits, and dispute provisions, survive to the extent permitted by law.
